Since the beginning of his career Mr. Policy has maintained a broad and diverse practice.  Beyond his litigation practice, Mr. Policy has decades of experience in commercial real estate transactions, representing major commercial and multi-family developers, as well as up and coming real estate developers, in the Washington, D.C. area.

Mark Policy practices in the areas of real estate acquisition and sales, commercial leasing, real estate finance, commercial and residential brokerage and property management, real estate development, administrative law, regulatory matters and both trial and appellate litigation. Mr. Policy has a broad range of litigation experience, including representation of the United States in the valuation of the former Penn Central Railroad and frequent representation of trade associations in litigation before trial courts and courts of appeal concerning issues which broadly impact the real estate industry. He has a well-recognized practice representing owners and managers of apartment buildings and commercial office buildings in real estate acquisitions, sales and financing, and leasing transactions involving office, retail, mixed-use, restaurant and business park projects in Washington D.C., Maryland and Virginia. Mr. Policy is also a well-recognized litigator in administrative proceedings before the D.C. Board of Elections and Ethics and before the trial courts and courts of appeal regarding ballot initiatives, referenda and election challenges.

Mr. Policy is presently representing a major utility supply company in the deregulated utilities markets in the District of Columbia and Maryland and in the developing open utility market in Virginia. For decades, he has represented a major university in its real estate transactions and related regulatory matters. Noteworthy litigated cases include Hessey v. D.C. Bd. of Elections & Ethics, 601 A.2d 3 (D.C. 1991) (preventing a ballot initiative from adversely affecting the District of Columbia budget), Williams v. D.C. Bd. of Elections & Ethics, 804 A.2d 316 (D.C. 2002) (representing the Mayor in a nominating petition challenge), and Apartment and Office Building Ass’n v. D.C. Public Service Commission, 129 A.3d 925 (D.C. 2016) (challenging a $1 billion program to underground utilities).

Mr. Policy is a founding shareholder of GDL. He is a member of the Board of Directors of a major utility supply company and a major education trust. He represents major trade associations in legislative matters and in litigation.
